TazKick Terms of Use

Operator: TazKick Inc
Business address: 8 The Green, Suite B, Dover DE 19901

1 About these Terms
These Terms of Use govern access to the TazKick website, application and related learning features (the "Service"). "TazKick", "we", "us" and "our" mean the operator identified above. "You" means the adult who accepts these Terms, including a parent or legal guardian acting for their household.
Please read these Terms before accepting them. Where acceptance is required to activate learning access, create a profile or make a purchase, the adult must be given a clear opportunity to review and agree to these Terms. If you do not agree, do not activate or purchase the Service. A child is not expected to enter into this agreement independently.
2 Children and adult responsibility
TazKick provides football education primarily for children aged 6 to 13. A parent or legal guardian must authorize a child's use and supervise it as appropriate for the child's age and needs. An adult accepting these Terms must be at least 18 and have legal capacity under the applicable law.
Only an adult may make purchases, manage subscriptions or submit adult contact details. Do not ask a child to make these decisions. Keep passwords and payment authorizations, where used, under adult control. You are responsible for your own actions and for reasonably supervising the use you authorize; this does not remove TazKick's legal responsibilities.
A school, club or coach may arrange access only within the authority it actually holds. Participation in a club or school does not by itself establish permission to collect a child's personal information or use their image.
3 The educational service
The Service may include tactical questions, interactive pitch scenarios, explanations, football history, team-building activities, progress indicators and virtual rewards. Features vary by version, device, language and access plan. The offer shown when you obtain access describes what is included.
TazKick supports learning about football. It does not guarantee improved match performance, selection by a club, scholarships or professional opportunities. Scores, XP and ranks reflect activities within the Service; they are not clinical, psychological or intelligence assessments.
If an activity encourages practice away from the screen, a responsible adult should choose a safe setting and suitable equipment. Follow the child's coach's and healthcare professional's advice where relevant. Stop an activity if it causes pain, dizziness or distress.
4 Permission to use the Service
Subject to these Terms and any applicable purchase terms, we grant you a limited, non-exclusive right to access the Service for your household's personal educational use. This permission lasts for the period of your valid access.
This permission does not transfer ownership of software, artwork or learning content. It does not authorize resale, redistribution, public commercial display or a commercial training service. Clubs and schools seeking group access should contact us for an appropriate arrangement. Any device or app-store usage rights that must be permitted by law or applicable marketplace terms remain available.
5 Profiles and saved progress
If profiles or accounts are provided, give accurate adult information and do not impersonate another person. Use a nickname or limited profile information where the Service permits it, rather than unnecessary identifying details about a child.
Some versions may save preferences and progress only on a device or in a browser. Clearing storage, changing devices or uninstalling may remove those local records. Do not assume that cloud backup, account recovery or synchronization is included unless the Service expressly offers it.
Report suspected unauthorized account access through the contact address above. Do not send passwords or full payment-card details by email.
6 Free access and beta testing
A free sample, promotional offer or beta release may provide temporary or limited access, including access to features normally subject to progression or payment. The offer will identify its duration or limits, if any.
Free beta access does not create a paid subscription and will not become chargeable merely because the beta ends. A paid plan requires a separate adult purchase decision and any legally required consent. Unless the offer expressly promises otherwise, beta access does not guarantee permanent access to every level, future features or transfer of test progress.
Beta features may change while being tested. This does not limit any rights that apply to a paid purchase or excuse us from our privacy and security obligations.
7 Purchases and subscriptions if offered
Paid access is available only where a purchase option is expressly offered. Before an adult completes a purchase, the checkout must identify the included access, total price, currency, billing period, any trial terms and whether renewal is automatic. Prices and taxes are those disclosed at checkout; no particular price or subscription is established by these Terms alone.
An automatically renewing subscription continues for the periods disclosed at purchase until cancelled. We will seek express consent to recurring charges where required, provide a retainable purchase confirmation and send the notices required by applicable law. Accepting these Terms alone is not consent to an undisclosed recurring charge.
A limited sample, including any offer of 20 free questions, does not itself authorize a later charge. Any trial that converts to a paid subscription must clearly disclose the conversion date, price and cancellation method before enrollment and obtain the required adult authorization.
Price changes apply prospectively, with the notice and renewed consent required by law or the relevant marketplace. A price change does not apply retroactively to an already paid period.
8 Cancellation and refunds
You may cancel automatic renewal through the channel where you subscribed. For Apple App Store or Google Play purchases, use that store's subscription-management settings. For a subscription bought directly from TazKick, use the online cancellation method supplied with the purchase; contact us if you need help. Cancellation must be available through the methods required by applicable law, without unreasonable obstacles.
Cancellation stops future renewals. Unless the purchase offer or applicable law provides otherwise, access continues until the end of the period already paid for. Deleting the app, clearing a profile or stopping use does not by itself cancel a subscription.
Refund eligibility depends on the purchase offer, applicable law and, where relevant, marketplace procedures. We do not impose a blanket "no refunds" rule. Statutory remedies for defective, misdescribed or undelivered digital services remain available. If a marketplace processed the payment, a request may need to be submitted through that marketplace; this does not remove any responsibility we have under applicable law.
Consumers in the European Economic Area, United Kingdom or other protected jurisdictions may have a cooling-off or withdrawal right. Any lawful request to start digital delivery immediately, and any acknowledgment affecting a withdrawal right, must be obtained separately where required. Merely accepting these Terms does not waive such a right.
9 Virtual rewards and team features
XP, ranks, badges and player cards are features of the educational experience. They do not represent real money, an investment, ownership of a real player or a transferable financial asset. There is no cash redemption or authorized external trading through TazKick.
We may correct errors or address manipulation of virtual progress fairly and proportionately. We will not remove purchased rights or apply material changes to paid access in a manner contrary to the purchase contract or consumer law.
10 Acceptable use
Use the Service lawfully and respect others. Do not misuse personal information, submit content you are not authorized to use, harass anyone or attempt to contact children improperly.
Do not introduce malicious software, interfere with security, access another person's profile without permission, manipulate progress through unauthorized tools, or copy and sell the Service's protected content.
Do not scrape protected content at scale or reverse engineer software except to the extent permitted by applicable law. These restrictions do not prevent lawful accessibility use, security reporting or other legally protected activities.
11 Intellectual property and third-party references
The Service contains software, text, artwork, audio, characters and other materials owned by TazKick or used under applicable rights. These Terms give you only the access and use rights expressly described; they do not give you ownership of those materials.
Third-party names, marks, photographs and other materials remain subject to their respective owners' rights. References to football players, teams, competitions or historical events do not, by themselves, mean those people or organizations sponsor, approve or are affiliated with TazKick. Any authorized partnership will be identified accurately.
Nothing in these Terms authorizes TazKick or a user to exploit another person's identity or third-party intellectual property without the necessary rights.
12 Privacy and children's information
Our Privacy Policy at [PRIVACY POLICY URL] explains the collection, use, sharing, retention and deletion of personal information and the rights available to parents and users. Read it before activating child access or providing information.
Agreement to these Terms is not verifiable parental consent to collect, use or disclose a child's personal information. Where applicable law requires parental notice or consent, the appropriate process must occur before the relevant processing, subject to lawful exceptions.
Parents may contact us to exercise applicable rights concerning their child's information. We may reasonably verify authority before disclosing or deleting personal information. A parent is not required to waive a child's privacy rights to accept these Terms.
13 App stores and external services
If you obtain the application through a marketplace, that marketplace's purchase rules and applicable software license also apply. These Terms govern your relationship with the TazKick operator and do not override mandatory marketplace protections or consumer rights.
External links or services may have their own terms and privacy practices. A link does not itself constitute an endorsement. TazKick remains responsible for the obligations the law places on us concerning providers we engage.
14 Updates and availability
We may maintain, correct and improve the Service, including by providing updates needed for security or functionality. We do not promise uninterrupted access or compatibility with every device. Requirements that affect a purchase must be disclosed before that purchase.
We will provide updates, notices and support required by applicable law or the purchase contract. If a change or discontinuation materially affects paid access, we will provide the notice, cancellation opportunity, refund or other remedy required by law. We will not remove statutory digital-content or service guarantees through these Terms.
15 Suspension and ending access
You may stop using the Service at any time, subject to any separate cancellation step needed to stop renewal. You may request account or profile closure through the contact details above or through any deletion feature provided.
We may restrict access when reasonably necessary to address a serious breach, security threat, unauthorized use or legal obligation. We will act proportionately and explain the reason and opportunity to remedy it where reasonably possible, unless doing so would be unlawful or compromise safety or security.
Ending access does not automatically extinguish refund rights or other accrued rights. Personal information will be handled under the Privacy Policy and applicable law; termination does not authorize indefinite retention.
16 Warranties and responsibility
We will exercise the care and skill required by applicable law and meet any non-excludable obligations concerning the Service. Except for promises expressly made in the purchase contract and rights that cannot lawfully be excluded, we do not guarantee particular learning outcomes, freedom from every error or uninterrupted availability.
Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited. Nothing limits mandatory privacy, consumer or digital-service rights.
Subject to those exclusions and only where applicable law permits, our total liability arising out of the Service is limited to the greater of US$100 and the amount you paid us for the Service in the 12 months before the event giving rise to the claim. That limit does not reduce a refund or remedy that consumer law requires. We do not exclude foreseeable losses where such an exclusion would be unlawful.
17 Complaints and applicable law
Please send questions or complaints to [SUPPORT EMAIL], describing the issue without unnecessary personal information about a child. We will consider the complaint and seek a reasonable resolution. Contacting us is not a condition for exercising statutory rights or meeting a legal deadline.
These Terms do not deprive consumers of mandatory protections in their country or state of residence. Governing law and the courts entitled to hear a dispute are determined by applicable law, including mandatory consumer-jurisdiction rules. You may use a competent court or any available consumer complaint or dispute-resolution process.
18 Changes to these Terms
We may update these Terms to reflect changes to the Service or the law. We will identify the effective date and provide reasonable advance notice of material changes through an appropriate channel. Where applicable law requires renewed agreement, we will obtain it.
Changes will not apply retroactively to an existing dispute or alter an already paid period contrary to law. An amendment to these Terms does not, by itself, authorize new charges or materially different processing of children's information.
19 General provisions
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not automatically waive it.
These Terms, together with the specific purchase terms accepted by the adult, form the agreement about access to the Service. A specific purchase promise and mandatory legal rights prevail over inconsistent general wording here. Privacy information and any necessary consent remain separate.
You may retain a copy of these Terms. Contact details for the operator appear at the beginning of this document.
